Tourist-Use Lease Agreement – La Caracola
Pursuant to Article 1, paragraph 2, letter c, of Italian Law No. 431 of 9 December 1998
Purpose of the Agreement
The Landlord grants a short-term lease for exclusively touristic purposes to the Guest (Tenant), who accepts, the property known as "La Caracola", located in Andora (SV), Via Aurelia 64, Int 3. This agreement is governed by Articles 1571 et seq. of the Italian Civil Code, Article 53 of Legislative Decree 79/2011, and Article 1, paragraph 2, letter c) of Law 431/98. Any form of sublease or granting of use to third parties is excluded.
Booking Finalisation and Payment
A request submitted through the website does not constitute a confirmed booking. The agreement is deemed finalised and binding only once:
1. The Landlord confirms the availability of the accommodation in writing (by email).
2. The Guest pays the deposit or balance within the terms and in the manner indicated in the confirmation communication.
If payment is not received within the set deadline, the booking request will be automatically cancelled.
Guest Data Reporting Obligation (AlloggiatiWeb — Police Headquarters)
In compliance with Article 109 of the Italian Public Security Consolidated Act (T.U.L.P.S.), the lead Guest is strictly required to complete the "Online Check-in" form before arriving at the property, providing the full personal details of all occupants and a valid identity document for the lead guest. Failure to provide this information, refusal, or partial disclosure will strictly prevent access to the property, with no right to a refund of amounts paid.
Security Deposit and House Rules
Rules of use: the Guest undertakes to review and strictly comply with the House Rules, which form an integral and substantial part of this agreement.
Deposit and penalties: upon arrival or at check-in, the Guest must pay the security deposit within the terms, methods and amounts specified in the House Rules and in the confirmation email. Loss of keys or violation of condominium rules will result in the extra costs and penalties indicated in the same House Rules. The deposit will be returned at check-out after verifying that no damage has occurred.
Withdrawal and Cancellation
Full-refund cancellation: the Guest may cancel the booking up to 14 days before the scheduled check-in date (local time at the property). In this case, the full amount paid for the stay will be refunded in full.
Late cancellation and no-show: in the event of cancellation within 14 days of arrival, or in the event of no-show, the full amount paid will not be refundable and will be retained in full by the Landlord as a penalty for late withdrawal.
Competent Court and Privacy
For any dispute arising from the interpretation or performance of this agreement, the Court of Savona shall have exclusive jurisdiction. Personal data provided will be processed in accordance with EU Regulation 2016/679 (GDPR) solely for purposes connected with the performance of the agreement and legal obligations.
